PRAGNUM defended a large Ukrainian developer in a tax dispute for UAH 34,000,000

The PRAGNUM team defended the interests of a large Ukrainian developer in a legal dispute with the tax inspectorate and appealed a tax decision notice in the amount of UAH 34,000,000, issued due to an allegedly illegal transfer of losses from previous periods. 

Despite the seemingly clear judicial practice in this matter, the court of first instance, having established the illegality of the tax authorities’ conclusions, nevertheless refused to satisfy the claim, since the firm’s client allegedly failed to confirm the amount of losses with primary documents, even though it was a desktop audit rather than a documentary one.

As part of the project, PRAGNUM provided comprehensive support to the client in legal proceedings, which subsequently resulted in the satisfaction of the filed appeal and the revocation of the tax decision notice by the Kyiv Administrative Court of Appeal.
