PRAGNUM protected the rights of cottage complex from pressure under law enforcement bodies

At one time the client decided to invest in the creation of a cottage complex located less than 20 kilometers from Kyiv. The new suburban complex combined all the necessary: modern infrastructure, comfortable recreation areas and a well-thought-out location concept.

Many years after the sale of the cottages, law enforcement bodies initiated criminal proceedings on the alleged fact of tax evasion by the client and by the buyer of the houses. As part of the investigation, investigators began to massively call the real estate buyers for questioning, send numerous requests to various institutions and organizations, effectively exerting systematic pressure on the client’s business.  Separately, calls were made to the owners and managers of the company with direct threats of criminal prosecution.

Lawyers of PRAGNUM quickly developed a comprehensive defense strategy, which included appealing to the authorities supervising the pre-trial investigation, communicating with members of Parliament and the Cabinet of Ministers of Ukraine, conducting their own legal interviews and also obtaining an independent expert opinion confirmed the absence of any tax evasion. 

The evidence gathered by the lawyers was added to the materials of criminal proceedings that together with an active legal position and involving of public and institutional control mechanisms made it possible to completely neutralize all claims by law enforcement bodies in the shortest possible time.

Law enforcement bodies also received a clear signal regarding the inadmissibility of such «investigations» in the future.
