Long-lasting power cuts have become not only a challenge for Ukrainian businesses, but also a powerful catalyst for the transition to alternative energy sources. Entrepreneurs are increasingly investing in solar generation, seeking to ensure operational stability and energy independence.
Our Client is the owner of a warehouse complex which premises are leased for storage of goods. He planned to install a solar power station on the roof of the facility and supply the generated electricity to the tenants, but initially approached PRAGNUM to have a legal advice on this issue.
However, in practice, the implementation of such a model turned out to be much more difficult than it was expected. Regulation in the field of electricity production and supply provides for a set of organizational, contractual and technical requirements. In certain cases, their implementation can create a burden for the owner of the facility, equal or even greater than the costs of installing the solar power station itself.
PRAGNUM lawyers comprehensively analyzed the legislation, regulatory requirements and specifics of the Client's business activities. Based on the results of this work, we developed an individual business model for the electricity sales process which:
• optimized documentary and administrative support;
• minimized regulatory risks;
• took into account the interests of both the owner of the facility and its tenants;
• ensured the economic feasibility of the project.
The proposed solution allowed the Client to implement the project within the legal framework, maintaining a balance between investment attractiveness and compliance.
