A large Lithuanian investor approached PRAGNUM and requested to develop a scheme for lending to individuals through an open-end mutual fund registered in Ukraine. The assignment was complicated by the legal limitations on the right of the Asset Management Company managing the fund to carry out operations to provide loans and credits at the expense of the fund’s assets. 

PRAGNUM experts have developed a scheme that allowed us to solve this problem in the safest and most cost-effective manner. We also developed effective mechanisms for protecting the investor’s funds. A scheme involving the transfer of mortgages as collateral was chosen to ensure the fulfilment of obligations to the investor. PRAGNUM drafted all the agreements necessary to implement the scheme, as well as provided advice to further secure the Client’s money and mitigate legal risks.
